The short answer: Under Personal Property Law 427, New York buyers can cancel a door-to-door sale until midnight of the third business day, and a mailed notice counts when it’s deposited in a mailbox. Under Section 428, the seller must give written notice in the same language as the contract and must tell you about the right out loud. Until the seller complies, you can cancel in any manner and by any means.
New York’s rule is unusually strong when the seller skipped steps. If you never got the written Notice of Cancellation, or no one told you about the right, the window hasn’t closed in the ordinary way.
New York General Business Law Section 349 prohibits deceptive acts and practices and lets consumers recover damages, with additional damages for willful violations. Contracts also can’t include a waiver of your cancellation rights.
New York’s Public Service Commission oversees net metering and has changed compensation for newer residential solar customers. Check which compensation structure your utility applied when your system was connected.
