The short answer: Indiana’s Home Solicitation Sales Act, IC 24-5-10, lets consumers cancel a home consumer transaction, and the supplier must deliver two copies of a written notice explaining the right, the steps to cancel and the deadline. After a valid cancellation, the supplier must return your payments within ten business days, and the right to cancel is in addition to any other remedy you have.
Look for the two copies of the notice and the deadline written on them. A missing or incomplete notice is a key issue for a reviewing attorney.
Indiana’s Deceptive Consumer Sales Act prohibits deceptive acts in consumer transactions, and the Attorney General’s Consumer Protection Division enforces it. Suppliers also can’t claim mitigation of damages when you properly cancel.
Indiana changed how utilities compensate new solar customers’ exported power, moving away from traditional net metering. Proposals that assumed full retail credits may not match your bills.
